How we handle your personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Our Commitment

We understand the importance of, and are committed to, complying with our obligations under the Privacy Act 1988 (Cth) (Privacy Act) and the associated Australian Privacy Principles (APPs). This document sets out our condensed Privacy Notice.

We need to collect personal information about you to provide you with our broking and related services. This Notice explains how we collect your information, what we use it for, and with whom we share it.

You appoint us as your agent (Access Seeker) to obtain your credit information from a credit reporting body on your behalf, for the purpose of assisting you with your finance application. You authorise us to disclose any credit information we obtain to prospective financiers in connection with your application.

Sensitive Information

Sensitive Information includes information about a person's racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of a professional or trade association or union, sexual preferences or practices, criminal record, or health information. We will not ask you to disclose sensitive information, but if you elect to provide it, it will be captured and stored securely.

How We Collect Your Information

We collect your information directly from you whenever we can, for example, when you make enquiries with us about credit assistance. We may verify that information from sources referred to in the responses to those enquiries.

Sometimes we collect information about you from other sources where the Privacy Act permits, including:

  • third parties about a loan or lease in relation to which you seek our services;
  • public information sources where we are unable to reach you and need to update your contact details; and
  • your legal or financial advisers or other representatives.

Some laws may also require us to collect personal information, for example, identity verification under Australian Anti-Money Laundering laws.

What Information We Collect

The types of information we collect and hold include:

  • Identification: name, postal or email address, telephone numbers, date of birth;
  • Other contact details such as social media handles;
  • Financial details, including your tax file number; and
  • Other information we reasonably consider necessary to provide our services.

How We Use Your Information

We may use your information for purposes including:

  • providing you with credit assistance;
  • providing you with information about loan products, related services, help, guidance, and advice;
  • considering your eligibility for a loan or lease, including identity verification;
  • assisting you to prepare a loan or lease application;
  • administering the services we provide, including answering requests and dealing with complaints;
  • administering payments we receive or make relating to your loan or lease;
  • informing you about other products or services that may interest you (unless you tell us not to);
  • preventing or investigating fraud or crime;
  • complying with laws, regulations, and codes binding us; and
  • any purpose to which you consent.

You can let us know at any time if you no longer wish to receive direct marketing offers from us. We will process your request as soon as practicable.

If You Do Not Provide Information

If you do not provide your information, it may not be possible for us to assist in finding a loan or lease relevant to your circumstances, verify your identity or protect against fraud, or let you know about products or services that might be suitable for your needs.

Sharing Your Information

With your representatives and referees

We may share your information with your representative or any person acting on your behalf (for example, lawyers, settlement agents, accountants, or real estate agents), and with your referees such as your employer to confirm details about you.

With third parties

We may share your information with third parties in connection with services we provide. Those third parties may include:

  • the broker group through which we submit loan or lease applications (you can view the broker group's privacy notice at choiceaggregationservices.com.au/privacy);
  • the Australian Credit Licence holder, ratesonline.com.au Pty Ltd, that authorises us to engage in credit activities;
  • referrers that referred your business to us;
  • financial services suppliers with which we have arrangements;
  • valuers, lenders, lessors, lenders' mortgage insurers, and other loan or lease intermediaries;
  • fraud reporting agencies and other organisations that identify, investigate, or prevent fraud or misconduct;
  • government or regulatory bodies as required or authorised by law;
  • guarantors and prospective guarantors;
  • service providers, agents, contractors, and advisers that assist us to conduct our business; and
  • any organisation that wishes to take an interest in our business or assets; or any third party to which you consent.

Sharing outside of Australia

Some of the recipients to whom we disclose your personal information may be based overseas, including in India and the Philippines. Australian Privacy Principle (APP) 8.1 does not apply to these disclosures, meaning that we will not be obliged under the Privacy Act to ensure that an overseas recipient does not breach the APPs. We may also store your information in cloud or other networked storage, which can be accessed from various countries via an internet connection.

Digital Consent

By providing us with your email address, you consent to us communicating with you via email, sending you documents electronically by email, and retrieving electronic signatures from you for the purposes of executing documents.

Accessing and Correcting Your Information
